Scriptorium

Terms of service

The agreement for using the Scriptorium app, its beta and this website.

Agreement to these terms

Effective date: October 22, 2026

These Terms of Service (the "Terms") are an agreement between you and Jacken Joseph Holland, an individual developer based in the United States ("we", "us" or "our"). They govern your use of Scriptorium, the Bible-study app for iPhone and iPad and for Android phones and tablets (the "App"), including its beta versions, and the Scriptorium website at https://scriptorium-bible.vercel.app (the "Site"). Together we call these the "Service". Scriptorium is made by one person, so "we" usually means that person.

By downloading, installing or using the App, subscribing to Scriptorium Plus, joining the waitlist, making a support payment, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

If you use the Service for an organization (such as a church), you confirm that you may accept these Terms for it, and "you" includes that organization.

Please read Disclaimers, Limitation of liability and Governing law and disputes carefully. They limit our responsibility and explain how disputes are handled. Nothing in these Terms takes away rights you have by law that cannot be taken away by contract.

The short version

This summary helps you find your way. The full Terms below are what count.

  • You can use Scriptorium for your own study. It is licensed to you, not sold.
  • Your journal, prayers and notes are yours. They stay on your device and in your iCloud. Keep backups.
  • AI answers can be wrong. They are not pastoral, medical, legal, financial or mental-health advice. Check them against Scripture and good sources.
  • The AI features need an account (sign in with Apple, Google or a code sent to your email) and a monthly AI allowance, which comes with Scriptorium Plus. You can delete your account in the App at any time.
  • Scriptorium Plus is an auto-renewing subscription, sold, renewed and refunded by Apple or Google. It renews until you cancel it in your App Store or Google Play settings. Deleting your account or the App does not cancel it.
  • Betas can break. Please tell us when they do.
  • Support payments ("chip in") are gifts to an independent developer, not charitable donations and not purchases.
  • If we disagree about something, let us talk first.

Who may use Scriptorium

  • You must be at least 13 years old to use the Service.
  • If you are under 18, or under the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you, and is responsible for your use of the Service.
  • If you live in the European Economic Area or the United Kingdom and are under 16 (or a lower age set by your country, not below 13), you may join the waitlist only with a parent or guardian's consent.
  • You must be at least 13 to create an Account, and at least 16 in the European Economic Area or the United Kingdom (or a lower age set by your country, not below 13) unless a parent or guardian agrees.
  • You may not use the Service if you are barred from doing so by the laws of the United States or the place where you live, or if you are on a US government list of prohibited or restricted parties.

Your license to use Scriptorium

The App is licensed, not sold, to you. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to:

  • download, install and use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (including Family Sharing where the App supports it); and
  • view and use the Site for your personal, non-commercial purposes.

This license lets you use the Service for your own study, prayer and teaching. You may share short quotations of Output and of our original text with attribution (for example, in a Bible study group, a sermon or a blog post). You may not otherwise copy, sell, rent, lend, distribute, publish, or make available the App, the Site or our content, except as these Terms or the law expressly allow.

We reserve all rights not expressly granted. The license ends automatically if you break these Terms, and when these Terms end. Third-Party Content has its own licenses; see Third-party content and licenses.

If you got the App from Google Play

Google's Google Play Terms of Service apply to how you get the App from Google Play. These Terms are between you and us only, not with Google. We, not Google, are responsible for the App and its content, its maintenance and support, and any claims about it.

Terms required by Apple

These Terms are meant to serve as our end user license agreement for the App. If the App's App Store listing uses Apple's Licensed Application End User License Agreement (the "Standard EULA") instead, both apply: the Standard EULA governs your license to the App, and these Terms govern everything else, including the Site, the AI Features and payments. If they conflict about your license to the App, the Standard EULA controls. Either way, this section applies if you got the App from Apple's App Store or TestFlight.

  1. Acknowledgement. These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
  2. Scope of license. Your license to the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing, where supported.
  3. Maintenance and support. We are solely responsible for providing any maintenance and support for the App, as described in these Terms or as required by law. Apple has no obligation whatsoever to furnish any maintenance and support services for the App.
  4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility, to the extent it cannot be disclaimed under these Terms.
  5. Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy or similar legislation. These Terms do not limit our liability to you beyond what applicable law permits.
  6. Intellectual property claims. If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of that claim.
  7. Legal compliance. You represent and warrant that (a) you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a "terrorist supporting" country; and (b) you are not listed on any US Government list of prohibited or restricted parties.
  8. Developer name and address. Questions, complaints or claims about the App should be sent to Jacken Joseph Holland, jacken.holland@gmail.com.
  9. Third-party terms. You must comply with applicable third-party terms when using the App, such as your wireless data service agreement and, when you use your own API key, Anthropic's terms.
  10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they relate to your license of the App. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Beta versions (TestFlight and Google Play testing)

We may invite you to try pre-release versions of the App through Apple's TestFlight or Google Play's testing tracks. If you take part:

  • It is unfinished. A beta may contain bugs, errors and incomplete features. It may crash, behave unexpectedly, or lose or corrupt data. Features may change or disappear before release. Do not rely on a beta for anything important, and export your data regularly.
  • It is temporary. Each TestFlight build expires after the period Apple sets (currently 90 days). We may end the beta, or your participation, at any time.
  • Apple's or Google's terms also apply. You must follow Apple's TestFlight terms or Google Play's terms for testers.
  • Accounts during the beta. During the beta, we may give Accounts a free Allowance, or the AI Features may need Scriptorium Plus, as the App shows. Accounts made during the beta carry over to the released App; if that ever changes, you will simply sign in again, and nothing on your device is lost. We may change the Allowance or pause the AI Features during the beta.
  • Feedback. We welcome bug reports, ideas and other feedback ("Feedback"). You are not required to give any. If you do, you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, copy, modify and incorporate it into the Service or anything else, without payment, credit or any obligation to you. Please do not include anything confidential or anything you do not have the right to share.
  • Confidentiality. We may mark some beta features as confidential. If we do, please do not share details of them publicly until we release them.
  • No warranty. Betas are provided "as is", without any warranty, to the fullest extent the law allows.

AI Features

What they are

The AI Features, called "AI" in the App, use Claude, AI models made by Anthropic. They are optional, and they need an Account and an Allowance (see The AI through Scriptorium, and your Allowance). Before you first use them, the App asks you to agree to send your requests to Anthropic, and you can turn them off at any time in Settings, under AI. Scriptorium's Bible texts, original languages, lexicons, cross references, maps, Sefaria sources, notes, journal, prayer list, reading plans, reminders, widgets and iCloud sync work without them.

AI can be wrong

AI Output is generated by a machine learning model. It can be inaccurate, incomplete, outdated, misleading, biased or offensive, even when it sounds confident. It can misquote Scripture, misattribute sources, invent sources or quotations, get dates and facts wrong, and present one interpretation as if it were the only one. The App reminds you of this under its answers. Specifically:

  • Check it. Always check Output against Scripture itself, the sources shown, and trusted teachers and references before relying on it or passing it on.
  • Report problems. If an answer is wrong, harmful or off-topic, use Report this answer. We review reports to improve the AI Features, but we cannot promise to correct or reply to each one. What a report sends is described in our Privacy Policy.
  • Source checks are limited. A mark such as "On Sefaria" means only that the name of a source Claude cited matches a text the App fetched from Sefaria. It does not mean the Output describes that source correctly. Labels such as "from memory" or "loosely" are Claude's own assessment and may be wrong.
  • Translation comparisons are from memory. When the AI discusses a translation whose text it is not given (for example, the ESV, or a licensed translation such as the NIV, whose text the App never sends to the AI), it writes from memory and can misquote it. Check against a printed or licensed copy.
  • Output may not be unique. Other people may receive the same or similar Output.

Not professional or pastoral advice

Scriptorium is a study tool. Output, prayer prompts and everything else in the Service are not pastoral counsel, spiritual direction, or the teaching of any church, and they are not medical, psychological, mental-health, legal, financial, tax or other professional advice. They do not replace your pastor, priest, rabbi, church, or a qualified professional. Scriptorium includes readings from many traditions, including Christian and Jewish sources; including a view is not an endorsement of it.

If you are in crisis or thinking about harming yourself, please contact local emergency services right away. In the United States, you can call or text 988 to reach the 988 Suicide and Crisis Lifeline.

Your Account

  • One person, one Account. Your Account is for you alone. Do not share it, sell it, or let others use it, and do not make more than one to get more Allowance.
  • Keep it secure. You sign in with Apple, Google or a 6-digit code sent to your email address, so keep those secure. Tell us at once if you think someone else is using your Account.
  • Accurate details. Use an email address you can receive mail at, so we can reach you about your Account.
  • Deleting it. You can delete your Account at any time in the App (Settings, then Account). Deleting it ends your access to the AI Features and to Scriptorium Plus through that Account. Your study content stays on your device and in your iCloud. Deleting your Account does not cancel Scriptorium Plus. Cancel it with Apple or Google if you no longer want it. If you keep it and later make a new Account, sign in to it and use Restore purchases to link the subscription to the new Account.

The AI through Scriptorium, and your Allowance

The App sends AI requests to our server, which checks your Account and passes them to Anthropic with our own Anthropic key. Our server chooses which Claude model answers each request; you do not choose a model. When you use the AI Features:

  • Your plan's Allowance. Scriptorium Plus includes a monthly Allowance. A free Account may have a small Allowance, or none. Your use counts against your Allowance, measured by what your requests cost us, including requests from features that start writing as soon as you open them and requests you stop partway. Every study starts at a standard level; Go deeper asks a more capable model for a deeper, longer answer, which uses more of your Allowance. The App shows how much of your Allowance is left.
  • Monthly reset. The Allowance resets on the 1st of each month (UTC). Unused Allowance does not carry over and has no cash value.
  • When it runs out, the AI Features pause until the Allowance resets. Everything else in the App keeps working. If your Account has no Allowance, the App offers Scriptorium Plus instead.
  • We may change it. We may change the size of the Allowance for any plan, set different Allowances for different Accounts, or change which Claude model answers each level, including a faster, lower-cost one, and we will show the current Allowance in the App. If we materially reduce what Scriptorium Plus includes, Changes to the Service applies.
  • Anthropic's rules apply. You must follow Anthropic's Usage Policy, which forms part of these Terms for your use of the AI Features.
  • Only through the App. Use the AI Features only through the App, for your own study. Do not use your Account, or our server, to reach Claude for anything else, or to make automated or bulk requests.

Your own API key (no longer offered)

Earlier beta versions let you use your own Anthropic API key instead of your Account. Versions from the App Store, Google Play and TestFlight no longer offer this; the AI Features work only through your Account. If you used your own key in an earlier version, that use was under your own agreement with Anthropic, and Anthropic's charges for it were yours. You can revoke the key at any time in the Anthropic Console.

Availability

The AI Features depend on Anthropic's service, which is outside our control. We do not guarantee that they will be available, uninterrupted, fast or error-free. Anthropic may change, limit or retire models or features, and we may change which models answer requests, the prompts the App uses, and how features work. Output may be cut short if it exceeds length limits.

Output

As between you and us, we claim no ownership of Output generated for you, and you may use it for any lawful purpose, subject to these Terms, Anthropic's terms, and the rights of others. You are responsible for how you use Output, including checking it and making sure your use of it does not infringe anyone's rights. Output that includes Third-Party Content (for example, Sefaria texts) remains subject to that content's license.

A shared library

In the future, guides that depend only on a passage or word may be taken from a shared library written earlier for another reader. If you report a problem with a guide, we may correct or rewrite it for everyone.

Your content

You own it

You keep all rights in your User Content. We do not claim ownership of your journal, prayers, notes or anything else you create.

The limited permission you give us

Today, your study content is stored on your device and, if you turn on iCloud sync, in your private iCloud database, which we cannot access. We do not host it. To the extent we ever process your User Content (for example, when you send us Feedback, join the waitlist, send a request through the AI Features, report an answer, ask for a translation, or post in a future shared feature), you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process and display it only as needed to operate and provide the Service to you, and to comply with the law. This license ends when the content is deleted from our systems, except for copies in backups for the limited time those backups are kept, and except for Feedback, which is covered by the license in Beta versions.

Your responsibilities

  • Backups. You are responsible for keeping backups of your User Content. Use Export (Settings, then Your data) regularly, and keep iCloud sync and device backups on if you want extra copies. Data on a device can be lost if the device is lost, reset or damaged, if the App is deleted, or if a beta has a bug.
  • Import and sync. Import replaces the data on your device and, with iCloud sync on, on your other devices. Sync merges changes from your devices and may resolve conflicts by keeping the most recent change.
  • Rights to what you import. Only import photos, reading plans and text you have the right to use. Printed reading plans are often copyrighted by a church or publisher; the App is meant for your personal use of a plan you already have.
  • Other people's information. Prayer lists and journals often mention other people. Please treat their information with care, especially before sending it to an AI Feature or sharing it.

Acceptable use

You agree not to, and not to help anyone else to:

  • use the Service in a way that breaks any law or regulation, or infringes anyone's rights, including intellectual property, privacy and publicity rights;
  • use the AI Features in a way that breaks Anthropic's Usage Policy, including to generate content that is illegal, harmful, harassing, hateful, sexually explicit involving minors, or designed to deceive, or to try to get around the model's safety measures;
  • use the AI Features, your Account or our server for purposes unrelated to Scriptorium, or to run automated or bulk requests;
  • scrape, crawl, harvest or systematically download content from the Service, including building a dataset or a competing product from Output, the shared library, or our compilation of data;
  • copy, modify, adapt, translate or create derivative works of the App, except as the law allows;
  • decompile, disassemble or reverse engineer the App, or try to derive its source code, except to the extent the law expressly allows this despite this restriction;
  • try to extract, intercept or misuse API keys, tokens or credentials, including sign-in tokens, other people's keys or Accounts, or our server's key;
  • interfere with or disrupt the Service, our servers or networks, or those of our providers; probe, scan or test their vulnerability without our written permission; or get around any security, rate limit, allowance or access control;
  • send spam, or submit false, misleading or someone else's information on the waitlist or elsewhere;
  • upload or send viruses, malware or other harmful code;
  • in any future shared feature, such as prayer groups: harass, bully, threaten, intimidate, shame or impersonate anyone; share another person's private information without their permission; post hateful, sexually explicit or violent content; or disrupt the group;
  • remove, hide or change any copyright, license, attribution or other notice in the Service; or
  • use the Service to build a competing product, or sell, resell or commercially exploit it without our written permission.

We may investigate suspected violations and take action we think appropriate, including removing content, lowering an Allowance, limiting or suspending access or an Account, and reporting unlawful conduct to the authorities.

Scriptorium Plus and in-app purchases

Scriptorium Plus is an optional, auto-renewing subscription. It pays for the AI Features and gives your Account a monthly Allowance (see The AI through Scriptorium, and your Allowance). The Bible, original languages, notes, journal, prayer and reading plans stay free, with or without it. The App has no other in-app purchases.

  • What it includes. While your subscription is active, your Account has the Scriptorium Plus Allowance for the AI Features, such as Passage Guides, word studies, history, commentary, Ask and Go deeper. The features, the Allowance and the models that answer may change over time, as described in your Allowance and Changes to the Service.
  • Sold through Apple or Google. On iPhone and iPad, you buy Scriptorium Plus in the App through Apple's In-App Purchase, and it is charged to your Apple Account. On Android, you buy it through Google Play's billing, and it is charged to your Google account. Apple's or Google's terms and payment policies also apply. We never see or store your payment details.
  • Plans and price. Scriptorium Plus is offered monthly or yearly. The price, the length of each period and any free trial are shown by the App Store or Google Play before you buy, in your local currency. Prices may include or exclude taxes depending on where you live, as the store shows. Payment is charged to your Apple Account or Google account when you confirm the purchase or, if you start with a free trial, when the trial ends.
  • Automatic renewal. Your subscription renews automatically at the end of each period, at the then-current price, until you cancel it. On the App Store, cancel at least 24 hours before the end of the current period to avoid the next charge; your Apple Account is charged for renewal within the 24 hours before the current period ends. On Google Play, cancel before the end of the current period.
  • Free trial. New subscribers may be offered a free trial, whose length is shown before you start. On the App Store, unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription and your Apple Account is charged. On Google Play, unless you cancel before the trial ends, it converts to a paid subscription and your Google account is charged. Each Apple Account or Google account may use a trial only once, as the store decides. Any unused part of a free trial is forfeited when you buy a subscription, where applicable.
  • Managing and cancelling. Manage or cancel Scriptorium Plus at any time in your App Store or Google Play account settings: on iPhone or iPad, Settings, then your name, then Subscriptions; on Android, the Google Play Store, then your profile, then Payments & subscriptions, then Subscriptions. Cancelling stops the next renewal, and you keep Scriptorium Plus until the end of the period you have paid for. Deleting the App, or deleting your Account, does not cancel a subscription.
  • Your Account. Scriptorium Plus works through your Account. Our server checks each purchase with Apple or Google, and links it to your Account, before your Account gets Scriptorium Plus. A subscription bought in the App stays with the Account you were signed in to: on a new device, sign in to the same Account and use Restore purchases. It cannot be moved to a different Account while that Account exists; if you delete that Account, a new Account can restore it.
  • Refunds. Refunds go through the store you bought from. For App Store purchases, ask Apple at reportaproblem.apple.com; Apple decides under its policies, and we cannot issue App Store refunds ourselves. For Google Play purchases, ask Google through your Google Play order history, under Google's refund policies. Except as required by law or the store's policies, payments are non-refundable and there are no refunds or credits for partial periods.
  • Price changes. We may change the price of Scriptorium Plus. Apple or Google will tell you before a new price applies to you, as their rules require, and where their rules or the law require it, will ask for your agreement first. If you do not want to pay the new price, you can cancel before it takes effect.
  • Offer codes. We may give founding members and others offer codes for Scriptorium Plus (Apple offer codes or Google Play promo codes). You redeem them in the App Store or Google Play, under the store's terms, which show what a code gives you and what happens when it ends. Codes have no cash value.
  • Family Sharing. Where we turn on Family Sharing for Scriptorium Plus, members of your family group may use it as Apple's rules allow.
  • Withdrawal rights. If you live in the EU or UK, any statutory right of withdrawal is handled by Apple or Google under their terms. Where the law allows, you agree that digital content and services start immediately after purchase, and you acknowledge that you may lose any right of withdrawal once they do.
  • Reviews. Benefits we offer early testers, supporters or founding members (such as offer codes) will never depend on you writing a review or a positive rating.

Support payments ("chip in")

The Site lets you make a voluntary payment to support Scriptorium's development ("Support Payment"). By making one, you understand and agree that:

  • It is a gift to an independent developer. Scriptorium is run by an individual, not a charity or non-profit organization. A Support Payment is not a charitable donation and is not tax-deductible.
  • It is not a purchase. You are not buying anything. A Support Payment does not give you any product, service, subscription, license, perk, priority, ownership, equity, investment interest or right to a refund or to any return. We are not promising to release the App, any feature, or any timeline. If we choose to thank supporters (for example, with an offer code for free time on Scriptorium Plus), that is a courtesy we may offer, with terms we will describe at the time.
  • It is processed by a third party. Payments are handled by Stripe, Inc. under its own terms and privacy policy. Its fees, currency conversion and your bank's charges may apply.
  • Refunds. Support Payments are non-refundable, except as required by law or the payment provider's policies. If you made a mistake (for example, a duplicate payment or the wrong amount), write to jacken.holland@gmail.com within 30 days and we will do our best to put it right.
  • How we use it. We use Support Payments at our discretion to develop and run Scriptorium, for example for testing, AI costs and App Store and Google Play fees.
  • Your own funds. You confirm that you are authorized to use the payment method, and, if you are under 18, that a parent or guardian has agreed.

Third-party content and licenses

Scriptorium brings together texts and data made by others. We are grateful to them. Each is used under its own license, and nothing in these Terms limits your rights under those licenses. We do not claim ownership of public-domain texts, and our rights in openly licensed data extend only to our own additions and arrangement.

Attribution. Content under a Creative Commons Attribution (CC BY) license is credited in the App where it appears and in Settings, under Sources. Its licensors do not endorse Scriptorium or your use of it. Content under CC BY-SA remains available to you under that same license. You can read the licenses at creativecommons.org/licenses.

Sefaria. Sefaria's texts are provided by Sefaria under its own terms of use and the license of each text. Scriptorium is not affiliated with or endorsed by Sefaria.

Third-party services and links. The Service works with services run by others, including Apple, Google, Anthropic, Sefaria, API.Bible, the payment provider and our hosting providers, and links to websites we do not control. We are not responsible for their content, availability, terms or practices. Your use of them is governed by their own terms and policies.

Our intellectual property

Except for Third-Party Content, User Content and Output generated for you, the Service and everything in it are owned by us or our licensors and are protected by copyright, trademark and other laws. This includes the App's and Site's software, design, look and feel, text we wrote (such as help text, onboarding and these documents), the selection, arrangement and presentation of data, the prompts we use with the AI Features, and, if we introduce one, the shared library of guides as a collection. These Terms do not give you any rights in them except the limited license in Your license to use Scriptorium.

Trademarks

"Scriptorium", the Scriptorium logo and related names and marks are our trademarks. You may not use them without our written permission, except to refer to the App accurately.

Apple, iPhone, iPad, iCloud, App Store, TestFlight and Siri are trademarks of Apple Inc. Android, Google and Google Play are trademarks of Google LLC. Claude and Anthropic are trademarks of Anthropic, PBC. Sefaria is a trademark of Sefaria, Inc. Other names are the trademarks of their owners.

Scriptorium is an independent project. It is not affiliated with, sponsored by or endorsed by Apple, Google, Anthropic, Sefaria, Tyndale House, OpenBible.info, any Bible publisher or translation committee, or any church, denomination or religious organization.

Privacy

Our Privacy Policy explains what happens to your information, and forms part of these Terms. In short, your study content stays on your device and in your private iCloud, and the AI Features send what they need through our server to Anthropic.

Changes to the Service

We are one person improving Scriptorium over time. We may add, change, suspend or remove features, content (including translations or sources whose licenses change), supported models, and supported devices or iOS versions, at any time. Some changes may require you to update the App. Where a change materially reduces something you have paid for, such as Scriptorium Plus, we will give you reasonable notice and, where the law or the store's policies require, a way to get a refund from Apple or Google. We may also stop offering the Service altogether; if we do, we will try to give you enough notice to export your data, which stays on your device and in your iCloud in any case.

Disclaimers

To the fullest extent permitted by law, the Service, including the App, the Site, the AI Features, all Output and all Third-Party Content, is provided "as is" and "as available", with all faults and without warranties of any kind, whether express, implied or statutory. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment and accuracy, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, timely, secure or error-free; that data will not be lost or corrupted; that sync will always succeed; that reminders will always be delivered; that defects will be corrected; or that any Output, translation, lexicon, cross reference, map, date or source is accurate, complete, reliable or suitable for any purpose.

Scriptorium presents Scripture, scholarship and interpretations from many traditions for study. It does not represent the doctrine of any church or tradition, and including a text or view does not mean we endorse it.

Some places do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you. If you are a consumer in the EU, the UK or another place with mandatory consumer protections, you have legal rights for digital content and services that are not as described or not of satisfactory quality, and nothing in these Terms affects those rights.

Limitation of liability

To the fullest extent permitted by law:

  • We will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, data or content, or for the cost of substitute services, arising out of or relating to these Terms or the Service, however caused and under any theory of liability (contract, tort including negligence, strict liability or otherwise), even if we have been told such damages are possible.
  • We are not liable for charges that Anthropic or any other provider bills to your account, including charges from features that start automatically, retries, or a key that is lost, shared or stolen, except to the extent caused by our gross negligence or willful misconduct.
  • We are not liable for decisions you make, or actions you take, in reliance on Output or other content in the Service.
  • Our total liability for all claims arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us, if any, in the 12 months before the event giving rise to the claim, and (b) US$50. Amounts you paid to Apple or Google for Scriptorium Plus count as paid to us for this purpose; Support Payments count as paid to us.

These limitations are an essential part of the bargain between us, and they apply even if a limited remedy fails of its essential purpose. They do not limit liability that cannot be limited by law, such as liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or, for consumers in the EU and UK, for gross negligence, willful misconduct or breach of your statutory rights. Some places do not allow the limitation or exclusion of certain damages, so some of these limitations may not apply to you.

Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold harmless us and our agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) brought by a third party and arising out of or relating to: (a) your breach of these Terms; (b) your violation of any law or the rights of another person; (c) your User Content; or (d) your misuse of the Service, including misuse of an API key. We will tell you about any such claim, and we may choose to control its defense, in which case you agree to cooperate. You may not settle a claim that affects us without our written consent. This section does not apply to consumers where local law does not allow it.

Ending these Terms

  • You may stop using the Service at any time by deleting the App, unsubscribing from our emails, and deleting your Account in the App. Cancel any subscription separately in your Apple Account or Google Play settings.
  • We may suspend or end your access to all or part of the Service, suspend or delete your Account, or refuse a waitlist or beta request, if you materially or repeatedly break these Terms, if we must for legal reasons, if your use creates risk or harm for others or for us, or if we stop offering the Service. Where reasonable, we will tell you why and give you a chance to fix the problem first.
  • What happens next. When these Terms end, your license ends and you must stop using the App. Your study content remains on your device and in your iCloud, and you can export it. Any sections that by their nature should continue will continue, including those on your content, Feedback, intellectual property, disclaimers, limitation of liability, indemnity and disputes.

Governing law and disputes

Talk to us first

Most concerns can be resolved quickly and informally. Before bringing a formal claim, you agree to send us a written description of the problem and what you would like us to do, at jacken.holland@gmail.com, and we will do the same for any claim we have against you. We will both try in good faith to resolve it within 60 days of the notice. This does not stop either of us from going to court to prevent imminent harm or to protect intellectual property, or from bringing a claim before a limitation period expires.

Governing law

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Courts

If we cannot resolve a dispute informally, it will be decided exclusively by the state or federal courts located in Florida, and you and we consent to the personal jurisdiction of those courts. However:

  • Small claims. Either of us may bring an individual claim in a small claims court with jurisdiction, either where you live or in Florida.
  • Consumers outside the United States. If you are a consumer living in the EU, the UK or another country whose law gives you this right, you may bring proceedings in the courts where you live, and you keep the protection of the mandatory consumer laws of your country. Nothing in this section affects those rights.

General terms

  • Entire agreement. These Terms, the Privacy Policy, and any additional terms we show you for a specific feature or offer, are the entire agreement between you and us about the Service, and replace any earlier agreements about it. If additional terms conflict with these Terms, the additional terms control for that feature or offer.
  • Severability. If any part of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted, or changed as little as needed to make it enforceable, and the rest of these Terms stays in effect.
  • No waiver. If we do not enforce a part of these Terms, that is not a waiver of our right to enforce it later.
  • Assignment. You may not assign or transfer these Terms without our written consent. We may assign them, for example to a company we form to run Scriptorium, or in connection with a transfer of the Service, if we tell you and the assignee agrees to honor them.
  • Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of Apple, Anthropic, Sefaria or other providers, internet failures, natural disasters, illness, war or government action.
  • Notices and electronic communications. We may give you notices by email (if we have your address), in the App or on the Site. You agree that notices, agreements and other communications we provide electronically satisfy any legal requirement that they be in writing. You may give us notices at jacken.holland@gmail.com.
  • Export control. You may not use, export or re-export the App except as US law and the laws of the place where you got it allow.
  • US government users. The App is a "commercial item" consisting of "commercial computer software" and "commercial computer software documentation", licensed to US government end users only as a commercial item and with only the rights given to all other users under these Terms.
  • Third-party beneficiaries. Apple and its subsidiaries are third-party beneficiaries as described in Terms required by Apple. Otherwise, no one else has rights under these Terms.
  • Relationship. These Terms do not create any partnership, joint venture, employment or agency relationship.
  • Interpretation. Headings and the short version are for convenience only. "Including" means "including without limitation".
  • Language. These Terms are written in English. If we provide a translation and there is a conflict, the English version controls, unless the law where you live requires otherwise.

Changes to these Terms

We may update these Terms, for example when we introduce new features such as accounts or a subscription, or when the law changes. The effective date at the top shows when they last changed. If a change is material, we will tell you before it takes effect, in the App, on the Site, or by email if you are on the waitlist, and give at least 30 days' notice of changes that reduce your rights, where practical. If you keep using the Service after a change takes effect, you accept the updated Terms. If you do not agree, stop using the Service and, if you have a subscription, cancel it. Changes do not apply to disputes that arose before the change.
